These Creator Program Terms (“Terms”) govern your participation in the BiteCaddy Creator Program (the “Program”). By submitting an application at bitecaddy.co/influencer/apply and continuing to participate, you agree to these Terms in full. BiteCaddy Inc. (“BiteCaddy,” “we,” “us”) may update these Terms at any time; continued participation after notice constitutes acceptance of the revised Terms.
1. Eligibility
To participate, you must (a) be at least 18 years old, (b) have an active social media presence on Instagram, TikTok, YouTube, X/Twitter, Facebook, Bluesky, or a similar platform, (c) maintain content that complies with the platform's rules, and (d) pass BiteCaddy's approval review. BiteCaddy reserves the right to approve or deny any application at its sole discretion.
2. Commission Structure
Approved creators earn a commission on qualifying paid subscriptions from users they refer through their unique code or link. The standard commission is:
- 30% of each payment made by a referred user
- Capped at 6 payments per referred user (covers approximately 6 months on a monthly plan or 1 cycle on an annual plan)
- 14-day refund hold on each payment before it becomes eligible for payout
Commission rates may be adjusted on a per-creator basis by mutual agreement. Your current rate is displayed on your creator dashboard.
3. Payouts
- Payouts are sent monthly via PayPal to the email address you provide during application
- A $25 USD minimum payout threshold applies; balances below this amount will accrue until the threshold is met
- Payouts are in USD only
- You must have an active PayPal account capable of receiving payments in your country; you are responsible for any fees PayPal charges
- BiteCaddy will issue IRS Form 1099-NEC for any US-based creator earning $600 or more in a calendar year; you are required to submit a Form W-9 upon request before the first payout in that year
- BiteCaddy may add additional payout methods in the future; changes will be communicated in advance
4. Content & Disclosure Requirements
You agree to:
- Disclose your affiliate relationship with BiteCaddy in every post, video, or recommendation that promotes the app, in compliance with the FTC Endorsement Guides (e.g., “#ad,” “sponsored,” or a clear verbal disclosure)
- Only make claims about BiteCaddy that are true and supported by the product's actual features
- Not guarantee specific financial, health, or dietary outcomes
- Not use misleading thumbnails, titles, or headlines that misrepresent the app
- Not post content that is defamatory, discriminatory, sexually explicit, or that violates applicable laws or platform policies
- Not use paid advertising that targets BiteCaddy's brand terms (e.g., bidding on “BiteCaddy” in Google Ads) without written permission
5. Brand Use
BiteCaddy grants you a limited, non-exclusive, revocable license to use the BiteCaddy name, logo, and mascot (“Chef Broc”) solely for the purpose of promoting the app under this Program. You may not (a) register domain names or social media handles containing “BiteCaddy,” (b) imply an official partnership or endorsement beyond the affiliate relationship, (c) modify the BiteCaddy logo, or (d) use BiteCaddy's brand in a way that damages its reputation.
6. Prohibited Activity
Commissions will not be paid, and your account may be suspended, if you:
- Use your own referral code to sign yourself up (“self-referral”)
- Create fake accounts, use bots, or artificially inflate clicks or signups
- Offer cash-back, rebates, or other financial incentives to users in exchange for using your code
- Spam, send unsolicited messages, or post your code in places where it violates the platform's terms
- Misrepresent yourself as a BiteCaddy employee or official spokesperson
- Share, sell, or transfer your referral code to another party
7. Commission Adjustments & Refunds
- Commissions on payments that are refunded, charged back, or fail due to billing issues will be voided
- Commissions held during the 14-day refund window may be rejected if the referred user cancels or refunds within that period
- BiteCaddy may adjust or void commissions retroactively if fraud or violation of these Terms is detected
8. Suspension & Termination
BiteCaddy may suspend or terminate your participation in the Program at any time, with or without notice, for any reason, including violation of these Terms. Upon suspension or termination: (a) you will no longer earn commissions, (b) any pending-hold commissions will be voided, (c) any already-approved commissions remain eligible for payout if they meet the $25 threshold, and (d) your Pro subscription benefit (if granted) will expire at the end of its current period. You may voluntarily leave the Program at any time by emailing us.
9. Pro Benefit
Approved creators may be granted complimentary access to BiteCaddy Pro for a period specified at the time of grant (typically 12 months). Pro is activated on your first recorded referral click, not on approval — this reserves the benefit for creators who actively promote the Program. Pro access is non-transferable and may be revoked if your creator account is suspended or terminated.
10. Relationship & Independent Contractor Status
You are an independent contractor. Nothing in these Terms creates an employer-employee relationship, partnership, joint venture, or agency between you and BiteCaddy. You are solely responsible for paying all applicable taxes on your commissions.
11. Privacy & Data
BiteCaddy collects and processes personal data you provide (name, email, social handles, payout details) solely for the purpose of administering the Program. See our Privacy Policy for details. You agree not to share personal data about BiteCaddy users you refer.
12. Limitation of Liability
BiteCaddy's total aggregate liability under these Terms is limited to the amount of commissions actually paid to you in the 12 months preceding the event giving rise to the claim. BiteCaddy is not liable for indirect, incidental, consequential, or punitive damages.
13. Changes to the Program
BiteCaddy may modify the commission rate, payout threshold, Program structure, or these Terms at any time. Material changes will be communicated via the email on file. Changes take effect on the date specified in the notice.
14. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in California.
